Terms & Conditions
These terms apply to the consultancy and design services provided by Thomas Franklin Developments Limited ("we", "us") and to the use of this website.
Scope of services
We provide residential development consultancy, building design consultancy, construction planning, architectural drawings and project advice. We are not a building contractor and we do not carry out construction works. References to development, planning or construction describe consultancy input, not building work or guaranteed results.
Engagement and fees
Each engagement is agreed in writing before work begins, stating the stage, the deliverables and the fee. Work is quoted and agreed stage by stage; additional stages are only started with your written approval.
Client responsibilities
You agree to provide accurate project information, documents and site access reasonably required for the agreed work, and to give feedback within a reasonable time so stage dates can be kept.
Planning and statutory decisions
Where we prepare or assist with planning submissions, statutory decisions rest solely with the local authority or other decision-making body. We do not warrant or guarantee any planning outcome, approval timescale or construction result.
Intellectual property
Drawings, appraisals, design documentation and other deliverables produced for your project remain our property until the corresponding fees are paid in full, after which you may use them for the project they were produced for.
Liability
We provide services with reasonable skill and care. Nothing in these terms limits our liability for death or personal injury caused by negligence, or for fraud. Subject to that, our liability for any claim connected with the services is limited to the fees paid for the stage of work from which the claim arises, and we are not liable for indirect or consequential loss.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
